1. About the Site

The Site describes our CEO advisory services and CEO Education offerings and lets you book a conversation with us. It is intended for business leaders who are at least 18 years old. If you use the Site on behalf of an organization, you confirm that you have authority to accept these Terms for it.

2. Information, Not Advice

​

Everything on the Site is general information about how we work. It is not advice for your specific situation.

 

Nothing on the Site is legal, tax, accounting, financial, investment, medical, or psychological advice. You remain responsible for your own business and personal decisions, and you should seek qualified professional advice where appropriate.

3. Illustrative Examples and Results

​

The Site includes illustrative examples of the value a decision or improvement might represent, such as revenue, EBITDA, and enterprise value figures. These examples are hypothetical. They are not forecasts, projections, or promises of what you or your company will achieve.

 

Testimonials reflect the individual experiences of the people quoted. Results depend on the company, the decisions made, the market, and execution, and your results will differ.

 

Figures describing Erik Musalem's experience and track record are provided for background. They do not guarantee any outcome for your engagement.

4. No Advisory Relationship Until We Agree in Writing

 

Using the Site, emailing us, or booking a conversation does not create an advisory, coaching, consulting, fiduciary, or other professional relationship with Evolve & Grow or Erik Musalem.

 

An advisory relationship begins only when you and Evolve & Grow sign a written engagement agreement. That agreement sets out the scope, fees, payment terms, schedule, cancellation terms, and confidentiality obligations for the CEO FITness Check-Up™, the CEO FITness Journey™, CEO FITness Sprints™, or any other service. If an engagement agreement conflicts with these Terms, the engagement agreement controls for the services it covers.

5. Booking a Conversation

 

Conversations are booked through a third-party scheduling service operated by Zoom. Your use of that service is subject to Zoom's own terms and privacy policy.

 

An introductory conversation is not covered by engagement confidentiality terms. Please do not share trade secrets, material nonpublic information, or other confidential information until an engagement agreement is in place.

 

We may decline, reschedule, or cancel a booked conversation at our discretion. If you need to reschedule, please use the link in your booking confirmation or email us.

6. CEO Express Check-Up™

 

The CEO Express Check-Up™ is a separate online tool with its own Terms of Use and Privacy Policy, which you accept before submitting it. Those documents govern your use of the Express Check-Up.

7. CEO Education

 

Our CEO Education offerings, including the book OUTGROWN, Aristotelian Walks, and CEO Retreats, may be offered on their own terms. Pricing, availability, registration, payment, cancellation, and refund terms for each offering will be provided at the time you register, pre-order, or purchase, and those terms apply to that offering. 8. Intellectual Property

 

The Site and its contents, including text, frameworks, methods, diagrams, graphics, logos, and design, are owned by or licensed to Evolve & Grow Studio LLC and are protected by intellectual property laws.

 

FIT Method™, CEO FITness Check-Up™, CEO Express Check-Up™, CEO FITness Journey™, CEO FITness Sprints™, Integrated CEO Evolution™, Whole CEO System™, and the Evolve & Grow name and logo are trademarks of Evolve & Grow Studio LLC. You may not use them without our prior written permission.

 

You may view and print pages of the Site for your own personal or internal business use. Without our prior written permission, you may not:

• Copy, reproduce, republish, or distribute Site content, except for brief quotations with clear attribution to Evolve & Grow.

• Adapt our frameworks, methods, or materials into a competing product, program, or service.

• Scrape, harvest, or systematically extract content from the Site by automated means.

• Use Site content to train, test, or improve artificial intelligence or machine learning systems.

• Remove any copyright, trademark, or other proprietary notice.

9. Acceptable Use

 

You agree not to:

• Use the Site for any unlawful purpose.

• Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems.

• Introduce viruses or other harmful code.

• Impersonate any person or misrepresent your affiliation with any person or organization.

• Use the Site to send unsolicited commercial messages.

10. Third-Party Links and Services

 

The Site links to services and websites we do not control, including Zoom, LinkedIn, and erikmusalem.com. We are not responsible for their content, availability, or privacy practices. A link does not mean we endorse the linked site.

11. Privacy

 

Our Privacy Policy explains how we collect and use personal information through the Site. By using the Site, you acknowledge that Policy.

12. Disclaimer of Warranties

 

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

 

TO THE FULLEST EXTENT PERMITTED BY LAW, EVOLVE & GROW STUDIO LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT.

 

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED US$100.

 

These limits do not apply to liability that cannot be limited or excluded under applicable law. Liability for paid services is governed by your engagement agreement.

14. Indemnification

 

You agree to indemnify and hold harmless Evolve & Grow Studio LLC and its owners, officers, employees, and contractors from third-party claims, losses, and reasonable costs, including legal fees, arising from your breach of these Terms or your misuse of the Site.

15. Governing Law and Venue

 

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising from or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the jurisdiction of those courts.

16. Language

 

These Terms are written in English. If we provide a translation, such as a Spanish version, the English version controls in the event of any conflict.

17. Changes to These Terms

 

We may update these Terms from time to time. The updated version takes effect when posted on this page with a new Last Updated date. Continuing to use the Site after that means you accept the updated Terms.

18. General

 

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent. These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the Site.
